1. Acceptance of Terms

By creating an account or using MyTrustworthy AI, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not create an account or use the service. These Terms are a separate agreement from our Privacy Policy, which governs our collection and use of your personal information. By using the service, you also acknowledge that you have read and understood the Privacy Policy.

2. Description of Service

MyTrustworthy AI is a local-first conversational AI platform built on four pillars: Mind, Body, Soul, and Creativity. The platform provides the following capabilities:

• AI Companions (SubCompanions): Specialized AI personas covering domains such as wisdom, spirituality, science, creativity, healthcare, legal topics, and more. Each companion has its own character, expertise, and ethical boundaries.
• Personalization: A memory system that remembers your preferences, interests, and conversation context to provide tailored responses. You control what the AI remembers and can erase memories at any time.
• Multi-domain conversations: Intelligent routing automatically directs your messages to the most appropriate companion based on the topic of discussion.
• Voice synthesis: Optional text-to-speech output using ElevenLabs and Edge TTS for natural-sounding voice responses.
• Document Analysis: You may submit document text or a URL for plain-language AI analysis. This feature is for informational purposes only and does not constitute legal, financial, or professional advice of any kind. Do not submit documents you are bound by NDA or attorney-client privilege to keep confidential.
• Translation — Submit text for AI-powered language translation. Text is processed in memory via Cloudflare Workers AI and not stored.
• Image Analysis — Upload an image for AI-powered description. Images are transmitted to Cloudflare Workers AI for inference and not retained.
• Image Generation — Generate images from text prompts via our local Stable Diffusion service (Free/Basic) or Cloudflare FLUX.1 (Plus/Pro). Generated images are not stored server-side.

Important: All AI-generated content on MyTrustworthy AI is provided for informational and entertainment purposes only. AI responses should not be treated as professional advice. See Section 6 (AI Disclaimers) for details.

3. Account Terms

• You may maintain only one account per person.
• Authentication is handled via magic link — a secure, passwordless login sent to your email address. You are responsible for maintaining access to your email account.
• You must provide a valid email address that you have access to.
• You must be at least 16 years of age to create an account and use the service. MyTrustworthy AI does not knowingly collect information from users under 16. See our Privacy Policy for our Children’s Privacy practices.
• You are responsible for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.

4. User Content

Your content — including conversations, memories (facts stored by the AI), and notes — remains your property. You retain all rights to the content you create on the platform.

• License to process: By using the service, you grant MyTrustworthy AI a limited license to process your content solely for the purpose of providing and improving the service. This includes generating AI responses, storing conversation history, and maintaining your memory profile.
• Encryption: All user content is encrypted at rest using AES-256 via PostgreSQL pgcrypto. Your conversations, facts, and notes are protected from unauthorized access.
• Data export: You can export all of your data at any time using the “Export My Data” option in Settings. The export includes your profile, conversations, memories, notes, and preferences.
• Data deletion: You can delete your account and all associated data at any time using the “Delete My Account” option in Settings. Deletion is immediate and permanent — all conversations, memories, notes, and profile information are removed.

5. Acceptable Use

When using MyTrustworthy AI, you agree not to:

• Use the platform to harm, harass, threaten, or intimidate others
• Generate illegal, abusive, or harmful content through AI interactions
• Attempt to extract, reconstruct, or reverse-engineer system prompts, safety instructions, or internal configurations of any AI companion
• Circumvent, disable, or interfere with safety features, content filters, or ethical boundaries built into the AI companions
• Use AI companion responses as a substitute for professional medical, legal, financial, or mental health advice (see Section 6)
• Impersonate another person or misrepresent your identity
• Reverse engineer, decompile, or disassemble the AI models, inference infrastructure, or platform source code
• Use automated tools, bots, or scripts to access the service in a manner that exceeds reasonable use or degrades service for others
• Transmit malware, viruses, or any code designed to disrupt or damage the platform
• Prohibited Content Detection. Our platform automatically scans submitted text and images for payment card data (PCI), protected health information (PHI/HIPAA), Social Security Numbers, and explicit/adult content (NSFW). Submissions triggering these detectors are blocked and logged. Repeated violations may result in account suspension.
• Image Content Policy. You may not upload, request generation of, or attempt to produce explicit, adult, hateful, or illegal imagery via any platform feature. Image generation and analysis features enforce a content safety classifier before processing.

6. AI Disclaimers

MyTrustworthy AI provides AI companions for conversation, learning, and personal reflection. AI companions are NOT licensed professionals. Specifically:

• Not therapists: The Wisdom Companion and its agents (psychology, resilience, empathy) provide general wellness perspectives, not clinical therapy or diagnosis. They are not substitutes for licensed mental health professionals.
• Not doctors: The Healthcare companion offers general health information, not medical diagnoses, treatment plans, or prescriptions. Always consult a qualified healthcare provider for medical concerns.
• Not lawyers: The Legal companion provides general legal information, not legal advice. It does not create an attorney-client relationship. Consult a licensed attorney for legal matters.
• Not financial advisors: The Money & Business companion offers general financial perspectives, not personalized investment advice. Consult a certified financial advisor for financial decisions.
• Not clergy: Religious companions (Jesus, Buddhism, Islam, Hinduism) provide information about faith traditions and spiritual perspectives. They are AI simulations, not ordained ministers, priests, imams, monks, or spiritual directors.
• Document Analysis: The Document Analysis feature summarises documents to help you understand them in plain language. It is not a licensed attorney and does not provide legal, financial, or professional advice of any kind. Analysis may miss clauses, mischaracterise provisions, or be incorrect. Always consult a qualified professional before acting on any document analysis. Never submit documents covered by attorney-client privilege or NDA obligations.

Always seek qualified professionals for serious matters. If you are experiencing a mental health crisis, contact your local emergency services or a crisis hotline immediately.

AI may produce inaccurate, incomplete, or misleading information (“hallucinations”). Verify important information from AI responses with authoritative sources before acting on it.

7. Intellectual Property

The MyTrustworthy AI platform — including its design, user interface, system prompts, routing logic, and companion configurations — is owned by the platform operator. All rights not expressly granted in these Terms are reserved.

Open-source software components used by the platform (including AI models, libraries, and frameworks) are governed by their respective open-source licenses.

AI model outputs generated in response to your inputs are not claimed as intellectual property of the platform. The platform makes no ownership claim over the content of AI responses provided to you.

8. Third-Party Services

MyTrustworthy AI integrates with the following external services to provide certain features:

• Tavily: Web search — used when you or the AI invoke real-time web search during a conversation (requires your consent)
• ElevenLabs: Voice synthesis — converts AI text responses to natural-sounding speech (requires your consent)
• AccuWeather: Weather information — provides location-based weather data when requested (requires your consent)
• Cloudflare: Content delivery network (CDN), web application firewall (WAF), and DDoS protection — secures all traffic to and from the platform

Each third-party service is subject to its own terms of service and privacy policy. Please refer to our Privacy Policy for details on what data is shared with each service and under what circumstances.

9. Limitation of Liability

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

MyTrustworthy AI does not warrant that:

• AI responses will be accurate, complete, or reliable
• The service will be uninterrupted, timely, secure, or error-free
• The service will meet your specific requirements
• Any errors in the service will be corrected

In no event shall the platform operator be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of or inability to use the service.

You expressly understand and agree that the platform operator shall not be liable for any decisions you make based on AI-generated content. To the maximum extent permitted by law, the aggregate liability of the platform operator for all claims relating to the service shall not exceed the amount you have paid for the service in the twelve months preceding the claim.

10. Termination

• By you: You may delete your account at any time through the “Delete My Account” option in Settings. Account deletion is self-service, immediate, and requires no approval or waiting period.
• By us: We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or pose a security risk to the platform or other users. Where possible, we will provide notice before suspension.
• Effect of termination: Upon account deletion or termination, all your data — including conversations, memories, notes, profile information, and consent records — will be permanently deleted in accordance with our Data Retention Policy. Consent records are retained for 5 years after withdrawal as required for legal compliance.

Your privacy is fundamental to MyTrustworthy AI. Please review our Privacy Policy for a complete description of how we collect, use, and protect your personal information.

California Residents (CCPA/CPRA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know, delete, correct, and limit use of sensitive personal information. We do not sell or share your personal information. See our Privacy Policy for details.

European Residents (GDPR)

If you are located in the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR), including the right of access, rectification, erasure, restriction, data portability, and the right to object. See our Privacy Policy for details on how to exercise these rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the use of the service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters relating to intellectual property rights or unauthorized access to the service.

13. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the version number and effective date at the top of this page. For major changes that materially affect your rights or obligations, we will notify you via the email address associated with your account.

Your continued use of the service after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the service and delete your account.
