1. Acceptance of Terms

By creating an account or using MyTrustworthy AI, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not create an account or use the service. These Terms are a separate agreement from our Privacy Policy, which governs our collection and use of your personal information. By using the service, you also acknowledge that you have read and understood the Privacy Policy.

MyTrustworthy AI is a local-first conversational AI platform built on four pillars: Mind, Body, Soul, and Creativity. The platform provides the following capabilities:

MyTrustworthy AI provides AI companions for conversation, learning, and personal reflection. AI companions are NOT licensed professionals. Specifically:

Always seek qualified professionals for serious matters. If you are experiencing a mental health crisis, contact your local emergency services or a crisis hotline immediately.

AI may produce inaccurate, incomplete, or misleading information (“hallucinations”). Verify important information from AI responses with authoritative sources before acting on it.

7. Intellectual Property

The MyTrustworthy AI platform — including its design, user interface, system prompts, routing logic, and companion configurations — is owned by the platform operator. All rights not expressly granted in these Terms are reserved.

Open-source software components used by the platform (including AI models, libraries, and frameworks) are governed by their respective open-source licenses.

AI model outputs generated in response to your inputs are not claimed as intellectual property of the platform. The platform makes no ownership claim over the content of AI responses provided to you.

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall the platform operator be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of or inability to use the service.

You expressly understand and agree that the platform operator shall not be liable for any decisions you make based on AI-generated content. To the maximum extent permitted by law, the aggregate liability of the platform operator for all claims relating to the service shall not exceed the amount you have paid for the service in the twelve months preceding the claim.

California Residents (CCPA/CPRA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know, delete, correct, and limit use of sensitive personal information. European Residents (GDPR)

If you are located in the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR), including the right of access, rectification, erasure, restriction, data portability, and the right to object. These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the use of the service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters relating to intellectual property rights or unauthorized access to the service.

13. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the version number and effective date at the top of this page. For major changes that materially affect your rights or obligations, we will notify you via the email address associated with your account.

Your continued use of the service after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the service and delete your account.
